Terms & Conditions

1. Subject of the Agreement

Coaching begins with an initial intake session (Intake/Anamnesis), in which the client identifies their topic or goal for coaching. The agreement regarding the coaching (written or verbal) refers to the goal stated in the intake form or anamnesis sheet.

The coach provides services based on the information supplied by the client. The client is responsible for the accuracy, completeness, and timeliness of this information. Recommendations and statements from the coach are solely intended to support the client’s own decisions and cannot replace them.

The coach guides the client with empathy and supports them in discovering their own solutions and paths, based on the information provided.


2. Applicability of the General Terms & Conditions

These GTC apply exclusively to all agreements between the coach and the client. Other terms, especially those of the client, are expressly excluded.

By accepting a pricing agreement or by continuing the agreement through attending an intake or session, the client acknowledges and accepts these General Terms and Conditions. Any deviations from these conditions are only valid if confirmed in writing by the coach.

2.1 Conclusion and Amendments of Agreements

An agreement may cover a coaching program or individual services.
It is concluded through the client’s written acceptance of the pricing agreement or verbal confirmation of an individual session.

Amendments or additions to the agreement only become effective if both parties have confirmed them in writing or verbally.


3. Responsibility of the Coach

The coach explains to the client at all times the methods, techniques, and interventions used, and points out potential outcomes or, where applicable, risks.

Coaching may lead to changes in the client’s life or relationships. The coach ensures that the client is informed about possible effects on their environment and understands that new behaviors or lifestyle measures are implemented responsibly by the client.

The coach accompanies the client empathetically, provides guidance on potential risks, and supports reflection on their own actions.

All information is treated confidentially and is not shared with third parties unless the client expressly requests and consents in writing. The coach maintains a record of the coaching process, which the client may review at any time.

4. Responsibility of the Client & Liability of the Coach

4.1 Personal Responsibility

Coaching is an active, self-directed process. The client is fully responsible for their physical and mental health during and between sessions. All actions, recommendations, or lifestyle tips are implemented independently by the client.

4.2 Disclaimer

The coach provides support and guidance to the best of their knowledge and ability. The coach assumes no liability for health complications or unexpected effects resulting from the client’s independent implementation of recommendations, except in cases of gross negligence or severe proven breach of duty. Consequential damages are excluded.

The coach’s liability is limited to the fee of a single session. The client is obliged to take all reasonable measures to minimize potential damage.

4.3 Recommendations Regarding Products / Tests

This also applies to recommendations regarding dietary supplements, products, or DNA tests (non-diagnostic). Responsibility for implementation, dosage, and intake lies entirely with the client.

The coach assumes no liability for the quality, composition, or origin of the recommended products or tests; these are the responsibility of the manufacturer or laboratory. The coach supports the client, as far as possible, with the correct handling of complaints regarding products or tests.

5. Special Notes for Coaching in Epigenetics, Holistic Health, and Consciousness

  • This coaching uses insights from epigenetics, holistic health, and consciousness work to support the client in their personal development.
  • The coaching is based on personal information, DNA tests (non-diagnostic), lifestyle and health data, and the client’s personal choices and goals. It serves to support, guide, and accompany, but does not replace medical diagnostics or treatment.
  • Recommendations may be given regarding nutrition, movement, lifestyle measures, supplementation, or DNA-based insights. These recommendations are holistic, individually tailored, and serve to support the client’s personal development.
  • Responsibility for implementation, dosage, and intake lies with the client. The coach provides guidance and support but assumes no liability for practical application.
  • The effectiveness of coaching depends on the client’s motivation, commitment, and personal responsibility. External factors such as daily life, environment, or personal circumstances can also affect progress. Therefore, the coach cannot guarantee results but provides tools, guidance, and support that the client can actively integrate into their life.
  • The goal is for the client to make conscious decisions, gain experiences, and take responsibility for their personal development, while the coach empathetically guides the process and points out potential risks.
    Changes in lifestyle, nutrition, or movement are always undertaken responsibly by the client. The coach provides guidance and recommendations but assumes no liability for implementation, dosage, or results.

6. Duration / Fees

  • Coaching sessions last 60 or 90 minutes, depending on the agreement.
  • Fees are based on the current rate list, the cost estimate, or the website page 'offerings' on the website yoursparklyself.com/en/offerings.
    Email or phone requests relating to coaching content are billed according to time spent. Simple scheduling queries are excluded.

6.1 Start Coaching Intake/Anamnesis

  • The client may decide within 48 hours after the intake session not to continue coaching free of charge. This gives the client time to decide whether the coaching meets the personal expectations. This must be communicated in writing.
  • After this period, the intake session is billed.

6.2 Billing / Payment

  • Invoices are issued after each session, multiple sessions, or at the end of the month. Payment is due within 5 days of invoice date.
  • In case of delay, the coach may suspend services; the client bears statutory interest on arrears and extrajudicial collection costs.

6.3 Coaching for Minors

  • For clients under 18 years of age, consent from parents or legal guardians is required.
  • Costs for minors who are not decision-capable are charged to their legal representatives.
  • From age 16, decision-capability is assumed; invoices are issued directly to the client unless legal representatives confirm in writing that they will cover the costs.

6.4 Questions or Complaints

  • Only written and substantiated questions or complaints submitted within 15 days of the invoice date will be considered. After this period, invoices are deemed correct and binding.
  • Questions or complaints do not suspend the payment deadline.

7. Termination

  • The agreement may be terminated by either party at any time, in writing, without providing reasons.
  • Already provided but not yet billed services must still be paid.

8. Appointment Cancellations / Missed Session Fees

  • Appointments should be canceled in writing at least 24 hours in advance.
  • In case of late cancellation or no-show, the time reserved for the client is fully charged. This ensures coaching time is fair and reliable.
  • The coach may reschedule appointments in case of emergencies or other serious reasons, with written notice within the possible timeframe.

9. Distinction from Therapy or Medical Treatment

Coaching is not psychotherapy or medical treatment and cannot replace it.
For complaints of medical concern or serious health worries, the client should always consult a (specialist) physician.

10. Data Protection & Confidentiality

  • All personal data, DNA test results, or other analyses are treated confidentially and only used for coaching purposes.
  • Disclosure to third parties only occurs with the explicit written consent of the client.

11. Final Provisions

  • Place of performance and jurisdiction (if legally permissible): Amsterdam, Netherlands.
    Dutch law applies.
  • Should any provision be partially or wholly invalid or leave gaps, the remaining provisions remain valid. The invalid or incomplete provision will be replaced by an appropriate arrangement, as close as possible to what the parties intended.
